Membership Terms and Conditions

These are the Terms & Conditions that apply to RaboDirect Rebels Membership.

The completed membership application (“Membership Application”) and Terms & Conditions form a legally binding contract (“Agreement”) between the person named on the Membership Application (“Member”) and RaboDirect Rebels.

Under the Agreement, the Member promises to comply with these Terms & Conditions including any Rules & Regulations imposed by the Venue on Members.

Interpretation

In these Terms & Conditions, the expression:

•           “Home Match” refers to any of the matches designated as a RaboDirect Rebels home match during the 2012 Super Rugby home and away season, and excludes any Finals Match

•           “Finals Match” refers to any match designated as a RaboDirect Rebels home finals match played at a Venue

•           “RaboDirect Rebels” refers to Melbourne Rebels Rugby Union Ltd ABN 70 140 597 066

•           “RaboDirect Rebels Membership” and “Membership” refers collectively to Weary Dunlop Rugby Club Membership, Platinum Membership, Gold Membership, Silver Membership, Silver 3 Game Membership, Blue Membership, Rebel Army Blue Membership Supporter Membership and Little Rebels Membership.

•           “RaboDirect Rebels Membership Offer” refers to the RaboDirect Rebels Membership Packages at www.melbournerebels.com.au

•           “Member” refers to any person who has paid in full a Membership Fee, who complies with these Terms & Conditions and who has not cancelled or surrendered the Membership under these Terms & Conditions

•           “Membership Fee” refers to the fee to become a Member on the terms set out in this Agreement

•           “Venue” refers collectively to AAMI Park Stadium, Etihad Stadium and any other stadium where a RaboDirect Rebels Home Match or Finals Match is played

If there is any inconsistency between information in the RaboDirect Rebels Membership Offer and these Terms & Conditions, then these Terms & Conditions will prevail.

 

Membership application and purchase

If your RaboDirect Rebels Membership Application is successful, RaboDirect Rebels will send you an email confirming your Membership. Members are required to provide a valid email address in your Membership Application in order to receive this confirmation.

RaboDirect Rebels reserves the right to refuse membership to any person at its absolute discretion.

Once a completed Membership Application is sent to RaboDirect Rebels your application is considered final and refunds and exchanges are only allowed as expressed in the “Refund Policy” of these Terms & Conditions.

 

Conditions of sale

It is a condition of sale that tickets to RaboDirect Rebels matches may not, without the prior written consent of the RaboDirect Rebels, be resold at a premium nor used for advertising, promotion or other commercial purposes (including competitor or trade promotions) or to enhance the demand for other goods or services. If a ticket is sold or used in breach of this condition, then the ticket may be cancelled and the bearer of the ticket may be denied admission.

The organisations in control of the Venues used for RaboDirect Rebels matches have the right to impose on Members Rules & Regulations and other operational decisions as may be directed by those organisations from time to time in its discretion. RaboDirect Rebels shall not be liable to Members for any matters arising as a result of the implementation of any such Rules & Regulations.

Rules & Regulations may discriminate between RaboDirect Rebels Membership categories.

It is a condition of sale that Members must comply with these Terms & Conditions, including the Rules & Regulations imposed by the organisation in control of the Venues, where RaboDirect Rebels matches are played. If any of these Terms & Condition or Rules & Regulations are breached, RaboDirect Rebels and the Venue reserves the right to refuse entry or to remove Members from the Venue.

All dates, times, participating teams and venues of matches will specified on the official Super Rugby website www.rugby.com.au and may change from time to time without notice to Members.

 

Membership Fees

Where applicable, RaboDirect Rebels will set the annual Membership Fee each year.

Membership Cards and packages will be issued after successful submission of a Membership Application to RaboDirect Rebels.

A three (3) instalment payment plan is available for all RaboDirect memberships. To be eligible the first instalment must be paid no later than 21 January 2012. The first instalment must be paid by credit card at the time of application. Deductions from your credit card will be made on the same date as the first instalment in the following two months. For example, if the first instalment is paid on 5 January 2012 the following two instalments will be deducted from your credit card on 5 February 2012 and 5 March 2012. A $5.00 fee is incurred, charged at $2.50 on each of the second and third instalments.

A 2% Credit Card Fee will be applied to all Visa & Mastercard payments. A 3% credit card fee will be applied to all American Express payments. The entire fee will be levied on the first payment if you choose the payment plan.

 

Family Membership information

Family Membership includes 2 Adults and 2 Juniors OR 1 Adult and 3 Juniors.

 

Junior Membership information

Junior Members with a game day membership (for the sake of clarity, not Little Rebels Members – refer below) must be 16 years or under as at 1 October 2011 and provide proof when requested.

RaboDirect Rebels does not provide, nor is it responsible for supervision of Junior Members.

 

Little Rebels Membership Information

Little Rebels Members do not gain entry to matches as part of their membership. Little Rebels Members must be 15 years or under as at 1 March 2012 and provide proof when requested.

RaboDirect Rebels does not provide, nor is it responsible for supervision of Little Rebels Members.

 

Concession Membership information

Concession Membership Fees apply to holders of a current Pensioner Card (aged, single parent or disability), or Veteran Affairs or TPI Association of Victoria card, or a student holding a full-time Student Card for 2011.

You must notify RaboDirect Rebels of your concession type and relevant Card Number on submitting a Membership Application. Concession identification must also be available for presentation when requested upon entry to the Venue on match day.

 

Refund Policy

RaboDirect Rebels will refund the face value of a ticket if:

•           The Ticket is for a Home Match which is cancelled and cannot be rescheduled, other than where a Home Match is cancelled as a result of events beyond RaboDirect Rebels’ control;

•           The Super Rugby Competition is cancelled; or

•           You are entitled to a refund by virtue of the operation of the Trade Practices Act 1974 (Cth) or similar legislation under which RaboDirect Rebels’ liability may not be excluded, restricted or modified by private agreement

RaboDirect Rebels is not liable to you for any loss or damage you suffer as a result of the Super Rugby Competition or any Home Match being cancelled, postponed or changed.

 

Membership Terms

RaboDirect Rebels reserves the right to change all or any of the Membership details enclosed in the RaboDirect Rebels Membership Offer.

RaboDirect Rebels reserves the right to offer additional Membership categories.

RaboDirect Rebels Membership expires on 31 August 2012 unless cancelled or surrendered earlier under these Terms & Conditions.

Membership is not inclusive of entry to pre or post Super Rugby home and away season matches or Finals Matches.

RaboDirect Rebels reserves the right to cancel a Membership without refund if the Member breaches these Terms & Conditions or any Rules & Regulations imposed by the Venues on Members.

 

Membership rights

RaboDirect Rebels Membership does not entitle the Member to any other right except as expressly set out in these Terms & Conditions and the RaboDirect Rebels Membership Offer.

Membership does not give a member the right to vote in any meeting of RaboDirect Rebels, to vote for any position on the Board of Directors or to participate in any dividend entitlement of any nature whatsoever.

A Member may surrender membership at any time by notice in writing to RaboDirect Rebels.

 

Membership seating allocation system

Membership Applications will be date stamped upon full payment of the Membership Fee. RaboDirect Rebels will allocate seating in the Weary Dunlop Rugby Club Membership, Platinum Membership, Gold Membership or Silver Membership categories in date order of receipt of full payment of the Membership Fee by RaboDirect Rebels or, if the Payment Plan option is selected, upon receipt of full payment of the first instalment of the Membership Fee by RaboDirect Rebels.

 

Sitting with fellow Members

When booking seats, Members may request that a group of fellow Members be seated together.

For group seating, Membership Applications for each Member must be submitted together. If Membership Applications are not submitted together, RaboDirect Rebels cannot guarantee Members will be seated together.

A group seating request may disadvantage your seating allocation. When a group seating Membership Application is submitted and different Membership Categories are requested, each Membership will be allocated to the lowest priority Membership category, i.e. if a Member purchases a Gold Membership and wishes to sit with a member who purchases Silver Membership, both Members’ seats will be allocated as a Silver Membership.

The priority of membership categories is as follows:

1.         Weary Dunlop Rugby Club Membership

2.         Platinum Membership

3.         Gold Membership

4.         Silver Membership

5.         Blue Membership / Rebel Army Blue Membership

6.         Silver 3 Game Membership

 

Membership seats under roof line

Reserved seats allocated in the Weary Dunlop Rugby Club Membership, Platinum Membership, Gold Membership or Silver Membership categories under the AAMI Park Stadium roof line does not guarantee protection from the weather.

 

Membership seats with restricted viewing

While RaboDirect Rebels has taken due care to notify members of areas of restricted viewing, additional seats may be sight restricted by match day signage or other operational requirements.

 

Home Matches at Etihad Stadium

In the event that a RaboDirect Rebels Home Match is played at Etihad Stadium, due to the different seating configuration available to RaboDirect Rebels at Etihad Stadium, same seat allocations will not be available at this venue.

RaboDirect Rebels will allocate seating at Etihad Stadium based on the level of membership held. The order of seat allocation priority for RaboDirect Rebels’ Home Matches at Etihad Stadium is as follows:

1.         Weary Dunlop Rugby Club Membership

2.         Platinum Membership

3.         Gold Membership

4.         Silver Membership

5.         Blue Membership / Rebel Army Blue Membership

6.         Silver 3 Game Membership

 

Pre and after match functions

Entry to any pre and after match functions is subject to availability.

Pre and after match functions will be fully licensed events unless otherwise communicated to Members. Minors are permitted entry to pre and after match functions when accompanied by an adult. Minors must be supervised by an adult at all times at pre and after match functions.

 

Entitlement to weekly communication during the 2012 Super Rugby home and away season

Members who are entitled to receive a weekly communication from the RaboDirect Rebels during the Super Rugby home and away season are required to provide a valid email address in the Membership Application.

 

Super Rugby Finals Matches

Membership entitles Members to priority access to purchase tickets to a Finals Match.

Should RaboDirect Rebels host a Finals Match, Members will be contacted regarding priority booking arrangements.

RaboDirect Rebels cannot guarantee the same seat(s) allocated to Members during the 2012 Super Rugby home and away season at a Finals Match. You may request the same seat with the ticketing agency at the time of purchase, however this is subject to availability.

Members’ priority periods may vary depending on the level of membership held. The order of ticket booking priority for Finals Matches is as follows:

1.         Weary Dunlop Rugby Club Membership

2.         Platinum Membership

3.         Gold Membership

4.         Silver Membership

5.         Blue Membership / Rebel Army Blue Membership

6.         Silver 3 Game Membership

 

Membership Cards

Issue and Use of Membership Cards

A Membership Card will be issued upon full payment of the Membership Fee and prior to the first RaboDirect Rebels Home Match of the 2012 Super Rugby home and away season. The Membership Card is issued for identification, and seat allocation purposes.

On the rear of the Membership Card you will find your details and seating allocation as well as a barcode. Your Membership Card is your ticket for RaboDirect Rebels Home Matches. On entry to the Venue your Membership Card will be scanned.

The Membership Card must be carried with you when attending Home Matches and must be presented upon request.

Lost or stolen Membership Cards

A Member must immediately report a lost or stolen card to RaboDirect Rebels. Lost or stolen Membership Cards will be cancelled upon notifying RaboDirect Rebels. A new Membership Card will be issued to the Member upon repayment of the replacement fee of $20.00. A new Membership Card will be issued prior to the next Home Match wherever possible. Membership Cards forgotten on match days

Where a Membership Card is forgotten on a Match Day, the Member will be required to complete the administration formalities and a ‘Day Pass’ will be issued.

Misuse of Membership Cards

If RaboDirect Rebels become aware of the misuse of Membership Cards, the Members’ rights may be suspended and/or the Membership may be cancelled, at the discretion of RaboDirect Rebels.

Faulty Membership Cards

A Member should advise RaboDirect Rebels if a Membership Card is faulty and a replacement Membership Card will be issued without charge.

Invitee Use

Where a Member cannot attend a Home Match then that Member can provide their Membership Card to another person (“Invitee”), which grants the Invitee the rights of entry to the Home Match as if they were the Member. The Member acknowledges that their Membership may be cancelled or terminated due to a breach of this Agreement or misconduct by the Invitee.

 

Administration of Membership

Termination of Membership

A Membership may be terminated for failure to comply with these Terms & Conditions. A Membership may also be cancelled due to the misconduct of a Member or the Invitee.

Change of Address

Please notify RaboDirect Rebels, in writing, as soon as possible of any changes in address or other details or update your details online at www.melbournerebels.com.au.

 

Privacy Notification

RaboDirect Rebels respects the privacy of the individuals on whom RaboDirect Rebels collects, uses, discloses and holds personal information. RaboDirect Rebels has a Privacy Policy that is based on the National Privacy Policy Principles contained in the Privacy Act 1988 (Cth).

RaboDirect Rebels uses the personal information it collects on the Membership Application for the purpose of processing and administering your Membership and providing you with information, materials and promotions relating to RaboDirect Rebels, its sponsors and the Australian Rugby Union Ltd, and will be applied in accordance with these Terms & Conditions.

By agreeing to become a Member of RaboDirect Rebels, you agree that your personal information pertaining to your membership may be disclosed to the Australian Rugby Union Ltd. Subject to the preceding paragraph, you may be contacted by Australian Rugby Union Ltd and RaboDirect Rebels’ sponsors during the life of your Membership in connection with their special offers and other information about their services and products. If you do not wish to receive any such information please tick the relevant box on the Membership Application.

Privacy Policy

Melbourne Rebels Rugby Union Ltd (“Melbourne Rebels”) respects the privacy of the individuals in relation to whom we collect, use, disclose and hold personal information. Our Privacy Policy seeks to safeguard the privacy of your personal information by observing the National Privacy Policy Principles (“NPPs”) contained in the Privacy Act 1988 (Cth) (“Privacy Act”).

In addition to this policy, we may also have specific and additional privacy provisions which apply to certain activities and promotions. In the event of any inconsistency between the provisions of this Privacy Policy and those other specific and additional provisions, the specific and additional provisions will prevail.

This policy (and our specific and additional privacy provisions) may be amended by Melbourne Rebels from time to time.

 

1. COLLECTION

a. Melbourne Rebels collects personal information primarily during the course of providing you with services, and when you:

i. request services be provided to you;

ii. purchase tickets for Melbourne Rebels’ matches;

iii. enter into competitions and promotions;

iv. subscribe to, or seek to be registered in or for, Melbourne Rebels membership programmes or newsletters; and

v. access Melbourne Rebels website.

b. We most commonly collect personal information in relation to rugby participants (both paid and unpaid), including without limitation players, officials, members, ticket purchasers, spectators, supporters, subscribers to our membership programmes, newsletters and promotional offers, and other persons.

c. The types of personal information we may collect depends on the purpose for which it has been collected, but may include your name, address, email address, telephone number, playing history, purchasing preferences and financial details, among other things.

d. Generally, if appropriate, we will tell you why we are collecting personal information and how we plan to use it, or these things will be obvious when we collect the information.

 

2. USE AND DISCLOSURE

a. We use personal information about you for the following primary purposes:

i. registration, selection and insurance purposes;

ii. provision of rugby activities and rugby-related services;

iii. assessing the level of interest in the game of Rugby Union; and

iv. provision of Melbourne Rebels and rugby-related information, materials and promotional opportunities by the Melbourne Rebels to you.

b. When you visit our website, Melbourne Rebels may record anonymous information which tells us about visitors to our website but not the identity of those visitors. For example, we may collect information about the date, time and duration of visits and which pages of our website are most commonly accessed to help us gauge the usage of our website. We may also use “cookies”. These are small pieces of information that allow an organisation to track the websites browsed by a person and customise website information to that person’s requirements and interests. You may be able to adjust your internet browser to disable cookies. If you do so, you may not be able to access some areas of our website or take advantage of the improved functionalities that cookies enable.

c. The security of your personal information is very important to us, and we are committed to protecting the information that we collect. We have security measures in place at our facilities to protect against the loss, misuse or alteration of information that Melbourne Rebels has collected from you at our website. Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100 percent secure. As a result, while we strive to protect your personal information, Melbourne Rebels cannot ensure or warrant the security of any information you transmit to us or from our online products or services, and you do so at your own risk.

d. We may use your personal information for direct marketing where it is impracticable for us to obtain your prior written consent. When we do so, however, we will provide an express option for you to decline receiving any further marketing communications from us. Notwithstanding this, we will only send you promotional emails if you have elected to receive them or if they are in response to an email we have received from you.

e. We may from time to time disclose your personal information to our service providers, agents and contractors to help us provide and market services to you. For example, we use third parties to provide credit card payment gateway services on our website. If you pay for services via our website we will provide certain financial details to third parties to provide this service. If we disclose information to third parties, we generally require these parties to protect your information in the same way we do.

f. We may also:

i. disclose your information to our affiliates (including without limitation Australian Rugby Union Ltd) to enable them to administer the game of Rugby Union and provide rugby activities and rugby-related services; and

ii. unless you inform us otherwise, disclose your information to our sponsors and partners to enable them to provide you with information, materials and promotional opportunities.

g. We reserve the right to share your personal information with third parties if we believe such action is necessary in order to:

i. conform with the requirements of the law or to comply with legal process served upon us;

ii. protect or defend our legal rights or property, or

iii. investigate, prevent or take action regarding illegal activities, suspected fraud, or violations of the terms and conditions of using Melbourne Rebels’ website.

 

3. DATA QUALITY AND SECURITY

a. Melbourne Rebels will also take reasonable steps to protect your personal information from misuse, loss and unauthorised access, modification or disclosure. However, as the internet is not a secure environment any information you send us via that method is sent at your own risk.

b. Our website may contain links which enable you to access other websites. We are not responsible for the content or privacy practices of those sites.

c. We will take reasonable steps to destroy or permanently de-identify personal information if it is no longer needed for any purpose for which the information may be used or disclosed and if we are no longer obliged at law to retain that information.

 

4. ACCESS, CORRECTION AND INQUIRIES

a. Melbourne Rebels will take reasonable steps to make sure that the personal information we hold on you is accurate, complete and up-to-date. If you think that any information we hold about you is inaccurate, please contact us.

b. In some circumstances you may gain access to the personal information which Melbourne Rebels (or third parties) hold on you. If you wish to know what sort of personal information Melbourne Rebels holds in relation to you, for what purposes it is held, and how we collect, hold, use and disclose that information, please contact us. In situations where we have provided your information to third parties, you may also contact us to obtain or verify that information. Before supplying any personal information to you we must be reasonably satisfied as to your identity (for example, by having sighted a copy of your driver’s licence). Melbourne Rebels is not under any obligation to provide personal information to you where we are not required to do so under the National Privacy Principals or otherwise at law.

c. All correction and access requests should be placed in writing and should set out as much information as you can about the information you seek, in order to help us retrieve it. We may charge an access fee to cover our costs of supplying personal information to you.

d. Melbourne Rebels may modify or amend this Privacy Policy from time to time. Changes to this Privacy Policy will not affect our use of previously provided personal information.

RaboDirect Conversions for Clubs Promotion (the “Competition”) Terms and Conditions

  1. Information on how to enter and prize details form part of these Terms and Conditions.  If there is any conflict between these Terms and Conditions and any other published material, these Terms and Conditions shall prevail. By entering this Competition, each entrant fully and unconditionally agrees to these Terms and Conditions and acknowledges that these Terms and Conditions are binding on them.
  2. The Promoter is Melbourne Rebels Rugby Union Ltd of Visy Park, Gate 3, Royal Parade, Carlton North, Victoria 3054, ABN 70 140 597 066.  Tel: +61 3 9221 0700.
  3. The Competition commences at 09:00hrs on Tuesday, 21 December 2012 and closes at approximately 17.00hrs on Thursday, 22 February 2012 (“Competition Period”).  All times and dates are times and dates in Melbourne AEST. All times are stated using the twenty-four (24) hour clock.
  4. Entry into the Competition is open during the Competition Period for any person who satisfies the following eligibility requirements:
    1. who is over eighteen (18) years old;
    2. who is not an employee or director of the Promoter or any of its related entities, or part of the immediate family of any such employee or director.  Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin; and
    3. who during the Competition Period: (i) attends the Weary Dunlop lunch at Crown Palladium, 8 Whiteman Street, Southbank, Victoria 3006 on Thursday, 23 June 2011 (the “Event”) as a ticket holder, and (ii) sends an SMS text message with their first name, last name and valid email address to the advertised promotional telephone number at the Event during the Competition Period.
  5. There is a limit of one (1) entry per person and email address.  Multiple entrants may not enter using the same email address.  An entrant may not enter using different email addresses.  Duplicate entries, either from the same person or the same email address will be disallowed.
  6. There are eight (8) prizes of $5000.00 in cash.
  7. The Prizes draw will be conducted at shortly after the close of the Competition Period at approximately 14:00hrs on Wednesday, 23 February 2012 at Melbourne Rebels Rugby Union, Gate 3, Visy Park, Carlton North, Victoria 3052.  The winners will be selected by calculating the eight (8) participating Rugby Clubs who provided the most 2012 RaboDirect Rebels Members.
  8. The Winners will be notified in writing by email to the provided email address by Thursday, 23 February 2012.  The Promoter takes no responsibility if the written confirmation to any of the Winners is undelivered due to unforseen circumstances.
  9. If for any reason whatsoever beyond the reasonable control of the Promoter, the Competition is not capable of being conducted as reasonably anticipated, including without limitation due to tampering, unauthorised intervention, fraud or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness or integrity or proper conduct of the Competition, the Promoter reserves the right, subject to written directions from regulatory bodies, in its sole discretion, to verify the validity of any entry, and suspend, modify, or terminate this Competition or disqualify any individual who tampers with the entry process.
  10. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any Prizes, except for any liability which cannot be excluded by law.  The Promoter will not be responsible for any incorrect, inaccurate, or incomplete information communicated in the course of or in connection with this Competition if the deficiency is occasioned by any cause outside the reasonable control of the Promoter.
  11. The Prizes are provided with a manufacturer’s warranty.  Any and all claims regarding the fitness for purpose, quality, use and operation of the Prizes should be directed to the manufacturer.  The Promoter makes no warranties as to the fitness for purpose or merchantable quality of the Prizes and accepts no responsibility for any defect with the Prizes.
  12. The Promoter collects personal information from all entrants in order to conduct this Competition. If the information requested is not provided, the entrant may not participate in the Competition or claim a Prize and their entry may be discarded.
  13. The Promoter, and its sponsors, may also use personal information collected about Competition entrants for direct marketing purposes (including marketing by electronic means where permitted by law). When the Promoter or its sponsors does so, however, it will provide an express option for entrants to decline receiving any further marketing communications from the Promoter.
  14. Each entrant consents to the personal information collected about them being disclosed to companies related to the Promoter, the Victorian Rugby Union Incorporated and sponsors of the Promoter (including but not limited to, Rabobank Australia Limited), and being used by those organisations for marketing purposes, (including marketing by electronic means where permitted by law).  Entrants can notify the Promoter if they do not wish the Promoter to pass on their personal information to these entities for marketing purposes by adding the words “no disclosure” at the end of their SMS text message referred to in paragraph 4.c(ii) above.
  15. Entrants’ personal information will only be used by the Promoter in accordance with the Promoter’s Privacy Policy.  This can be found on the Promoter’s website at http://melbournerebels.com.au/PrivacyPolicy/tabid/295/language/en-US/Default.aspx.  The Promoter may be contacted by telephone on +61 3 9221 0700 if an entrant wishes to gain access to their personal information.
